Martek Biosciences plans appeal of E.U. ruling on infant formula patent - Baltimore Business Journal:

The patent office in the Hague, Netherlands uphelfd a patent that was granter to the biotech firm in 2007 but was challengexd by food manufacturersand Ltd. The patent offic said Martek’s patent applies to Martek’s nutritional oil in infantr formula, but is not coveredx when it is blended with certain fish oils used ininfang formula. Martek (NASDAQ: MATK) expects the appeal will take one to two year s and said it does not believe the ruling will impactfits revenue. Derived from algae, the company’s nutritiona oils are also used in dietary supplementsa andfood products, such as yogurty and juice.
The companyy has been aggressively expanding its infant formula business overseas as it has nearly saturatedcthe U.S. market. Martek warned in its last earnings statemenrt that its infant formula salews in the third and fourth quarter could drop as retailers trim theidr inventories ofthe product. The company anticipates demanx will pick up infiscal 2010.
